Employment Law

This is a very specialised area of law which is comprised of both non-contentious and contentious matters.

Non-Contentious Employment Law
Our firm will be able to assist you with non-contentious employment law matters, which broadly involves drafting, reviewing and/or providing advice on employment contracts, contracting and sub-contracting agreements, restraints, non-compete and/or non-solicitation arrangements and other contracts involving the employer-employee or the business-independent contractor relationship.  We are in the process of growing our non-contentious employment law practice and will accordingly be able to assist you with:--

  • the preparation or review of employment contracts
  • the preparation or review of contracting and sub-contracting agreements or arrangements
  • the preparation or review of restraint, non-compete, non-solicitation and other similar restrictions
  • the implications of and the rights of the employer and/or the employee under South Africa's Labour Relations Act 1995, the Basic Conditions of Employment Act 1997 and the Employment Equity Act 1998

Contentious Employment Law
The field of contentious employment law broadly includes assistance with labour disputes, dispute resolution and/or the bringing or defending of claims and actions at the Commission for Conciliation, Mediation and Arbitration (CCMA) or in South Africa's Labour Courts.

We will act as your primary point of contact for contentious employment law matters but will work closely with one of our specialist, associate firms, which will be able to assist you with the following:--

  • advice in relation to labour disputes
  • assistance with the obtaining or opposing of interdicts (including on an urgent basis)
  • assistance with dispute resolution
  • advice and guidance in relation to unfair labour practices and the basic conditions of employment
  • the implications of and the rights of the employer and/or the employee under South Africa's Labour Relations Act 1995, the Basic Conditions of Employment Act 1997 and the Employment Equity Act 1998
